Apple is facing a lawsuit over not informing users of the actual amount of storage space required to operate their iOS 8 operating system.
The suit is centered around the claim that iOS 8 takes up so much storage space on iPhones, iPads, and iPods that users have significantly less room to store their own data than as advertised. As of January 2nd Apple has not released an official comment on the matter. The suit has been filed in California by Miami residents Paul Orshan and Christopher Endara. The plaintiffs claim that iOS 8 can occupy up to 23.1% of the storage available on some Apple devices. They also claim that upgrading devices from iOS 7 to iOS 8 can use up an additional 1.3 gigabytes of storage space.
The plaintiffs allege that lack of memory card support to increase storage capacity and opaque storage claims is a ploy to get Apple users to use the iCloud service. The suit alleges that Apple displays advertisements for the iCloud service once storage on a device is near full capacity. The lawsuit is seeking millions of dollars for damages for users who have been impact by this lack of storage space. “In reality, nothing close to the advertised capacity of the Devices is available to end users. Indeed, the discrepancy between advertised and available capacity is substantial and beyond any possible reasonable expectation” stated the plaintiffs’ attorney Jonas Mann in a court filing.
One example of the storage shrink showed in the filing was for the iPhone 6 Plus. The filing alleges that the an iPhone 6 Plus with 16 gigabytes of storage has only 12.7 gigabytes of usable storage. That means that there is 21% less storage space than the advertised 16 gigabytes of storage. The plaintiffs seek to have their suit certified as a class action. The plaintiffs are suing under California’s unfair competition and false advertisement laws.
