The Sinking City Returns After Publisher Dispute

The Sinking City Steam Store page has progressed following a temporary injunction in a legal dispute between the game's developer Frogwares and its publisher Nacon (formerly Bigben Interactive).

The Sinking City Steam Store page has progressed following a temporary injunction in a legal dispute between the game's developer Frogwares and its publisher Nacon (formerly Bigben Interactive).

Last year, The Sinking City was delisted from several digital storefronts due to a publisher dispute. Frogwares alleged that Nacon was violating the game's publishing agreement. These issues are not easily resolved and it's taking several months for French courts to examine the case and make a determination. This legal battle is still in progress, but Nacon has elected to move forward with bringing the game back to digital storefronts following a temporary decision by the court.

As SteamDB showsThe Sinking City Steam page was removed a little more than six months ago. It quietly made a return towards the end of 2020, but Nacon has only elected to put out an official announcement today.

"Confirmed in its expectations by this decision and regardless of the time needed to resolve this dispute definitively, NACON is continuing its action in defense of its rights and has proceeded with the execution of this court decision by asking platforms and sites to put The Sinking City game back online so that no one is held hostage to this situation," read a press release from the publisher

A quote from the court ruling was included with the press release.

The Court ruled that Frogwares had terminated the contract in a "manifestly unlawful" manner and, as a result, ordered, as a "precautionary measure, the continuation of the contract (...) until its term or until a decision is made on the breach of this contract and ordered Frogwares Ireland to refrain from any action on the breach of this contract and ordered Frogwares Ireland to refrain from any action that impedes this continuation (...)".

It should be noted, however, that this won't necessarily be a fully-functional revival — the press release notes that some of the online functionality depends on "the goodwill of Frogwares to perform."
