Activision Offering Guitar Hero Live Refund For Purchasers

Activision is offering refunds to customers who may have purchased their flagship rhythm game Guitar Hero Live.

According to a listing on the main website, customers who purchased the Guitar Hero Live gaming system (referring to the main game and guitar bundle) on or after December 1st, 2017 to January 1st, 2019, can qualify for Guitar Hero Live refund. Those who qualify must prove their date of purchase, submit a completed claim form by May 1st, 2019 and have their purchase confirmed either through a receipt or credit card statement to prove it was purchased at that time. Those without either receipt or a statement can still submit a form to Activision, who will attempt to prove the eligibility of the claim.

The news of the refund comes almost seven months after it was announced that Guitar Hero Live's Guitar Hero TV would shut down in December of 2018. The shuttering of Guitar Hero TV was a devastating blow, as it made nearly 500 songs in their database unplayable, leaving only 42 songs for the entire game. This roughly cut down on the content of Guitar Hero Live by 92%.

The shutting down of the servers also led to potential legal troubles for the company. Robert Fishel, a California native, and a customer who purchased Guitar Hero Live filed a proposal for a class action lawsuit against Activision in September of last year. Fishel claimed that marketing materials promised, "an always-on music video network... running 24-hours a day, seven days a week." With the servers shutting down, Fishel accused Activision of false advertising,  stating that the shutdown was not "disclose[d] prominently and conspicuously" before it took place.

Fishel's lawsuit was dismissed voluntarily without prejudice on January 22nd, meaning he can file it again in the future if he wishes.

Guitar Hero Live was released on October 20th, 2015, and for three years would feature online services for the popular Guitar Hero franchise. With those servers now officially dead, only the games retail version, containing 42 songs licensed for the game specifically, are now available.
